Berg Studios Acting Studio is a professional, private acting training studio owned and operated by Gregory A. Berger and Berg Studios, Inc. (hereinafter referred to as “Berg Studios, Inc.,” “Berg Studios,” “we,” “us,” “the Company,” or “the Studio”). In order to effectively serve the entertainment community, the Studio establishes the following Terms and Conditions governing participation in its programs, communication with staff, and attendance at any virtual or in-person offerings.
Any engagement with Studio services—including, but not limited to, enrolling in classes, attending sessions, or otherwise participating in Studio activities, whether in person or virtually—shall constitute acceptance of these Terms and Conditions, regardless of whether payment has been made at the time of participation.
By enrolling in or participating in Studio services, you (hereinafter referred to as the “Student,” “Actor,” “Attendee,” “Customer,” “Visitor,” “Vendor,” or “Guest”) acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
Admission & Company Rights
Berg Studios Acting Studio is a private acting training studio and reserves the right, at its sole discretion, to accept or deny admission to any individual for any program, whether conducted online or in person. The Studio further reserves the right to refuse, limit, or revoke access to its virtual platforms and/or physical premises at any time.
Failure to comply with Studio policies or guidelines may result in dismissal from the Studio without refund.
Class formats may vary, and additional terms and conditions may apply to specific programs. Any such terms, as well as supplemental rules and expectations, will be communicated in advance via welcome materials and/or by Stage Manager(s) at the beginning of each class.
Except for programs specifically designated for youth actors, participation in Studio classes is limited to individuals 18 years of age or older. Adult classes are intended for participants 18+. Limited exceptions may be made for qualified younger actors with prior training and experience, subject to industry referral, parental or legal guardian supervision, and prior written approval from the Studio.
LIMITATIONS OF LIABILITY, INDEMNITY, HOLD- HARMLESS
The Student agrees to indemnify, defend, and hold harmless the Studio, its affiliates, and each of their respective officers, directors, employees, agents, successors, and assigns from and against any and all losses, liabilities, damages (including taxes), costs, and expenses—including reasonable attorneys’ fees, disbursements, and costs of investigation, litigation, settlement, judgment, interest, and penalties (collectively, “Losses”)—arising out of or relating to any third-party claims, demands, or actions, whether actual or threatened, resulting from or related to: (i) the Student’s actual or alleged breach of any representation, warranty, or obligation under this Agreement; (ii) the negligent, willful, intentional, bad faith, or reckless acts or omissions of the Student or any individual acting on the Student’s behalf; (iii) the unauthorized disclosure, use, or loss of the Studio’s confidential information, including non-public personal information, in violation of this Agreement or any applicable laws, regulations, or data privacy and security requirements; or (iv) death, personal injury, bodily injury, or property damage caused by or arising from the acts or omissions of the Student or any associated parties in connection with Studio services, whether occurring on Studio premises, during virtual programming, or at any Studio-sponsored or related activity.
The Studio agrees to indemnify, defend, and hold harmless the Student and the Student’s officers, directors, employees, agents, successors, and assigns from and against all losses arising from third-party claims, demands, or actions for death, personal injury, bodily injury, or property damage, but only to the extent directly caused by the negligence or wrongful acts of the Studio or its services.
The Student and any visitors acknowledge and agree that they remain fully responsible and liable for their own actions, as well as the actions of any third parties they invite, engage, or permit to participate, including but not limited to guests, associates, or subcontractors.
For the safety and security of the Studio and its community, unauthorized access to Studio property or platforms is strictly prohibited. This includes trespassing on physical premises or accessing virtual programming outside of designated times or without prior authorization. Additional Studio policies may apply and must be followed at all times.
In no event shall the Studio be liable for any indirect, incidental, consequential, or punitive damages. The total liability of the Studio, if any, shall not exceed the amount actually paid by the Student for the applicable services, and the Student shall not be entitled to any compensation, refund, penalty, or damages beyond such amount.
ACCESSIBILITY
The Studio endeavors to make its facilities, website, and programs as accessible as reasonably possible to all actors. However, certain limitations may exist due to the nature of the Studio’s leased physical premises and the inherent constraints of online learning environments. The Studio seeks to comply with the Americans with Disabilities Act and all other applicable laws, regulations, and recognized best practices relating to accessibility.

Certain programs may not be appropriate for all ages or experience levels. Admission to any Studio program is determined at the sole discretion of the Studio and its faculty.
DESCRIPTION OF SERVICES, ERRORS, OMISSIONS
The Studio is a private acting training studio dedicated to teaching acting technique and supporting actors of all experience levels in the development of their craft. The Studio provides educational and informational services only and does not operate as a talent agency, management company, casting office, or career counseling service.
The Studio does not procure or attempt to procure employment or professional opportunities for students and makes no representations or guarantees regarding professional success, employment, or advancement in the entertainment industry. Acting is a highly personal and subjective art form, and outcomes will vary. All instruction, including but not limited to classes, lectures, assignments, coaching, feedback, critiques, and advice, is provided solely for educational purposes and reflects subjective professional perspectives. Nothing provided by the Studio shall be construed as legal, financial, or career advice.
To the fullest extent permitted by law, the Studio shall not be liable for any errors or omissions in its services or for any impact such services may have on a student’s professional pursuits.
The Studio is bonded and insured as a private acting training facility.
Acting training may involve the authentic and truthful use of personal emotions, memories, and experiences. The Studio is committed to fostering a respectful and supportive environment in which students may safely explore their work without fear of coercion, manipulation, or undue pressure. The Studio maintains professional standards regarding confidentiality and respect for the personal nature of information that may be shared in a class or group setting.
Due to the nature of this work, students are encouraged to ensure they are in appropriate mental and emotional health prior to enrollment and to practice responsible self-care while participating in Studio activities. If concerns regarding a student’s physical or emotional well-being arise, the Studio and its faculty reserve the right to address such concerns and, where appropriate, recommend alternative options or a pause in participation.
Unless otherwise specified, Studio classes are intended for individuals 18 years of age or older. Youth participation is limited to programs specifically designated for young actors, and applicable age requirements will be stated in program descriptions.
The Studio is bonded and insured. All instructors working with minors in designated youth programs hold any legally required Child Performer Services (CPS) permits, where applicable.
Payments & Refunds
Class materials & resources
Certain classes may require the use of props or a specific wardrobe. Students are responsible for their own preparation. There is no requirement to purchase items for class, particularly where such purchases would be excessive. While outside rehearsal and preparation are expected, and students may need to obtain tools necessary for their work, a student’s success is not determined by the amount spent outside of class.
Studio classes and programs may include homework and require additional materials. Homework may consist of, but is not limited to, reading assignments, memorization, outside rehearsals, and other reasonable tasks consistent with class expectations. All supplemental materials provided by the Studio—including, but not limited to, flyers, faculty articles or biographies, handouts, floor plans, booklets, class contact lists, in-class announcements, and class-specific language or lecture content—are the sole intellectual property of the Studio and its faculty and may not be copied, reproduced, distributed, or used for any purpose outside of class without express written permission.
Educational materials such as scripts or sides, to which the Studio does not claim ownership, are used in accordance with applicable law, including fair use principles. Unless explicitly stated otherwise, the Studio does not endorse or recommend any third-party resources (including, but not limited to, links, articles, websites, printed materials, or class referrals) that may be shared in class or among students.
Certain classes may require students to prepare or obtain additional reasonable materials to support coursework (for example, a specific prop or wardrobe item required for a scene, or basic materials for voiceover exercises). Such requirements are considered part of assigned homework. The Studio is not responsible for providing or reimbursing the cost of these materials. While students are responsible for their preparation, continued participation in a class will not be based solely on a student’s ability to obtain additional materials or services where doing so would create a hardship. Students may request clarification regarding what constitutes required versus recommended materials.
The Studio may engage in partnerships, sponsorships, or paid promotions across its platforms, including social media. In such instances, the Studio may disclose any material relationships where it is a financial partner or beneficiary. Participation in Studio programs offered through promotions or third-party partners remains subject to these Terms and Conditions.
Payment Policy
All class payments are nonrefundable and non-transferable. Any notification from a student about a pause in enrollment is due to the office via email by the 23rd of the month prior. Financial commitment to a class is final regardless of any student conflicts arising after this deadline. For ongoing scene study and on-camera classes, the student agrees to recurring charges on the 26th of every month per the student payment policy.
All tuition due must be paid before the start of classes. In the instance of a last-minute student conflict, a tuition payment or portion thereof may, at the Studio’s sole discretion, be held as a credit for 6 months or transferred one-time to a similar class by the same instructor. No refunds may be issued after the deadline, or for partial classes/classes missed, nor are they guaranteed for individual/student conflicts, whether they arise before, during, or after a given class – the Studio shall have sole discretion to issue refunds/partial refunds on a case-by-case basis for extenuating circumstances. Students should email the studio first in any case of a charge dispute. The Studio will follow up on any disputed charges where there is no reasonable basis for a reversal of the charge, and reserves the right to pursue any loss or damages arising from said dispute.
Payment of tuition is not a guarantee of continued study at the Studio or progression into any advanced level of a given program. In any case where a student has failed to abide by our policies or class expectations, or in any reasonable instance where the faculty has determined a student not fit to continue, a refund may be offered, but is not guaranteed.
Classes are by invitation only, regardless of payment status.
A receipt will be generated at the time of payment from our website/ credit card merchant. We accept all major credit cards in person, online, or e-invoice (no cash or personal checks), as well as ACH for certain purchases. The Studio may partner with third-party credit card processors and/or deferred payment providers (such as Afterpay), and additional terms and conditions may apply depending on the merchant.
Enrollment is incomplete without a corresponding payment/deposit. Deposits are accepted for all classes and workshops; however, payment in full is required prior to the start of your class or workshop. Private coaching payments are typically handled via e-invoice and must be paid in full before your session. Private coaching cancellations within 24 hours of the scheduled time are non-refundable
Some classes require specific instructor approval/application; in these instances the Studio shall have sole discretion on admission. We reserve the right to refuse service or admittance to anyone at any time.
All sales for online classes are final. As with in-person classes, if a student is enrolled but unable to attend the class/program and notifies the Studio before 1 week prior to the start date, tuition may roll over/transfer one time as a credit to a similar class at the Studio’s sole discretion. Unless otherwise arranged and approved in writing by the Studio, all tuition/fees are non-refundable and non-transferable.
Due to high demand and waitlists, the Studio cannot guarantee any refund or transfer for last-minute drops, no shows, or voluntary withdrawals. The Studio is not responsible for technical issues arising on the student’s part when accessing our online programs, nor shall the Studio be responsible for students’ failure to understand or confirm dates/start times ahead of their class, especially in instances where there is a time zone difference.
In any instance where a payment plan is established for a student, and the deadline/amount due is amended, these same terms and conditions shall apply to that mutual agreement.
Attendance & expectations
For first-time auditors or guests, whether online or in person, arrival prior to the posted start time is required.
Students are expected to prioritize class attendance. Attendance for all Studio courses and intensives is mandatory, with limited exceptions for documented extenuating circumstances. Attendance on the first day of any class is required and non-negotiable. The faculty reserves the right to dismiss any student based on attendance, including missed classes or material deemed essential.
Students are solely responsible for any missed class time or work. If a class session considered essential is missed, the student may not be permitted to participate in subsequent exercises, and no tuition will be refunded for missed work. The Studio does not offer makeup classes. The first class session is always considered essential. All class dates and times are provided in the student’s welcome email.
If a student must miss a class due to a professional obligation, such as an audition or booked work, the Studio should be notified as soon as possible. Continuation in any class or program following an absence remains at the Studio’s sole discretion.
Certain intensives (including, but not limited to, voice and speech, voiceover, and specific advanced programs) require full attendance and participation for the entire scheduled class session. Absence from such classes may result in dismissal without refund, and any credit or transfer will be granted solely at the Studio’s discretion.
Any student running late must notify their class manager and the Studio office in advance. Failure to communicate lateness or absence may affect a student’s ability to continue in the program. Expectations for reliability and punctuality also apply to outside rehearsals. The Studio maintains a professional environment that depends on consistent attendance, communication, and mutual respect.
Ongoing students are required to communicate any absences or missed class time to their stage manager, the Studio office, and any scene partners whose work may be affected. Repeated or inconsistent attendance may result in forfeiture of the student’s place in the class. Makeup classes are not offered, and attendance at scheduled sessions is the responsibility of the student.
Unless otherwise stated, the same standards regarding attendance, punctuality, communication, and participation apply to all online programs.
General studio policies
Students are required to leave the Studio in good condition after each class and are responsible for their personal items, trash, recycling, and other waste. Designated bins must be used, and all food waste must be disposed of properly. Negligent care or misuse of the space is not permitted.
No food or drink, other than water or approved props, is permitted in the Studio’s theater. Gum is strictly prohibited in the theater.
Studio property, including but not limited to plays, plants, office furniture, and other fixtures, may not be used as props or furniture without prior express permission from Studio administration. Any requests regarding props,
furniture, scene requirements, or storage of items at the Studio must be
approved in advance.
Unauthorized use of Studio property or facilities resulting in damage or loss valued at $50 or less, whether due to negligence or intentional conduct, may result in a fine and/or cleaning or replacement fee, payable within 30 days. For damages exceeding this amount, or in cases of gross negligence or misuse, the Studio reserves the right to pursue additional remedies to recover losses.
Students are solely responsible for their personal property. Lost and found items may be retained by the Studio for up to 30 days. The Studio is not responsible for lost, stolen, or damaged items, and students are encouraged to exercise reasonable care with personal belongings.
The Studio does not generally provide rehearsal space, except in limited circumstances, including but not limited to: (i) coordinating technical elements such as props, furniture, or staging logistics; (ii) rehearsing physical contact or staged movement requiring the Studio’s dimensions or setup for safety; or (iii) situations where a safe or appropriate alternative rehearsal environment is not available.
Student safety is a priority; however, the Studio is not responsible for the actions of students or third parties, or for incidents occurring outside of its control. Students are encouraged to exercise reasonable caution when traveling to and from the Studio, during breaks, and when rehearsing off-site. For online participation, students should take appropriate measures to protect their privacy and security, including maintaining updated software and exercising caution when using audio and video features.
In the event of a medical or emergency situation, students should immediately contact emergency services (911). For non-emergency concerns, students should contact their class manager or the Studio at contact@bergstudios.com.
To promote safety and security:
- Weapons are strictly prohibited on Studio premises.
- Props involving weapons (including but not limited to knives, swords, or replica firearms) must be approved in advance and inspected prior to use by authorized personnel.
- Such props may only be handled by designated individuals and only when required for a scene.
- Open flames (including candles, lighters, or matches) must be used responsibly, may not be left unattended, and must be extinguished immediately after use.
- Students and staff must be familiar with all exits, fire extinguishers, and first aid equipment.
- Authorized personnel must maintain access to exterior doors and ensure clear walkways and proper communication of emergency exits.
- Scenes requiring additional safety considerations must be approved in advance.
- Students may not enter private offices or restricted areas without prior authorization.
Any misuse of hazardous items or violation of safety policies may result in immediate dismissal.
The Studio utilizes video surveillance and alarm systems for security purposes. For additional information, please refer to the “Notice of filming/ photography” section.
With respect to unlawful conduct, any student or attendee who engages in illegal activity on Studio premises, at Studio events, within online programs, or through use of Studio resources or communications—including harassment, misuse of personal information, or other inappropriate or unlawful behavior—may be immediately dismissed without refund and may
be subject to legal action.
The Studio reserves the right, to the extent permitted by law, to discontinue services or dismiss any individual whose conduct, whether on or off premises, is deemed to adversely affect the safety, well-being, or integrity of the Studio community. The Studio reserves the right to refuse service to any individual.
Use of the Studio’s facilities, property, technology, or resources for any unlawful or prohibited activity is strictly forbidden. This includes, but is not limited to, use of the physical space, surrounding areas, Wi-Fi network, equipment, materials, personnel, or online platforms. Any such conduct may result in immediate dismissal and legal action to the fullest extent permitted by law.
Notice of filming and photography
These Terms and Conditions constitute notice that filming, photography, and audio recording may occur on Studio premises and within Studio online programs. Nothing herein is intended to supersede or conflict with applicable federal, state, or local laws. The Studio operates in compliance with all applicable laws and regulations, including California’s two-party consent requirements.
By entering the Studio’s physical premises or participating in any virtual programming—including, but not limited to, classes, lectures, audits, open houses, and question-and-answer sessions—individuals acknowledge and consent to being recorded in accordance with applicable law and these Terms and Conditions.
To the fullest extent permitted by law, individuals recorded pursuant to this policy agree to release and hold harmless the Studio from any claims arising from the use or misuse of such recordings, except to the extent resulting from the Studio’s willful misconduct or unlawful acts. Unless otherwise agreed in writing, no individual shall be entitled to compensation, credit, or remuneration for the Studio’s use of such recordings. All recordings created by the Studio are considered proprietary and may not be copied, reproduced, distributed, or otherwise used without the Studio’s prior written consent. By attending Studio programs, individuals waive any rights or claims related to the use of their name, image, likeness, or voice in such recordings for lawful Studio purposes.
For personal educational use only, students may audio record in-class critiques, lectures, and assignments. This serves as notice that participants may be recorded by other students for these limited purposes. Individuals who object to such recording are responsible for addressing their concerns directly with those participants. Faculty members may not be recorded by students or third parties without their express written consent. Still photographs of props, furniture, or scene setups may be taken for logistical purposes. Recording, filming, or photographing classwork, scenes, or faculty without prior authorization from the Studio is prohibited. Classwork may not be recorded or shared publicly under any circumstances without express permission.
Personal photographs, including selfies and group photos, taken in permitted areas such as the lobby, exterior, or theater, are allowed provided they do not violate Studio policies, applicable law, or the rights of others. The Studio encourages positive sharing of experiences; however, as a private business, it reserves the right to restrict or prohibit recording, posting, or sharing that may compromise privacy, safety, intellectual property, or the Studio’s reputation. Unauthorized or inappropriate recording or distribution of images, likenesses, or video may result in disciplinary action.
The Studio utilizes closed-circuit video surveillance, including visible and non-visible systems, for safety and security purposes. By entering the premises, individuals consent to such recording. Security footage is stored on private systems and is not publicly accessible.
Audio and video communications with Studio faculty may be monitored or recorded for quality assurance and security purposes. The Studio and its faculty may also record classes or other activities for these purposes. Notwithstanding the foregoing, the Studio reserves the right to record any online program, in whole or in part, for lawful purposes, including but not limited to archival use, educational distribution, marketing and advertising, and inclusion in future products or services. By participating in online programs, individuals acknowledge and agree that any recordings may be used by the Studio for such purposes without compensation, and waive any related claims or rights.
Students may notify Studio administration if they object to the recording or use of their image or likeness. Online participants may also adjust their personal device settings to limit audio or video participation. Questions or concerns regarding recording practices may be directed to contact@bergstudios.com. For additional information regarding the collection and use of personal information, please refer to the Studio’s privacy policy.
Online Class Addendum
The Studio offers online programs in addition to its in-person training. All online classes are subject to the same Terms and Conditions as in-studio programs, and the virtual learning environment is considered an extension of the Studio’s physical premises. All services provided through online programs are governed by these policies. Online classes are conducted primarily via Zoom. Participants are responsible for maintaining a compatible device, reliable internet connection, and an up-to-date Zoom application.
Upon receipt of payment, participants will receive a confirmation email containing instructions and information for accessing their online class. Students are responsible for checking their inbox and spam folders prior to the start of class and for confirming receipt of all required information. Any technical issues must be communicated to the Studio with sufficient notice to allow for a reasonable opportunity to respond and assist.
To ensure proper enrollment and identification, participants must provide their full name at registration and use the same name when logging into Zoom. Participant names may be visible to others in the session.
Students are responsible for reviewing all program details, including dates, times, content, and expectations, before enrollment, and for accounting for any applicable time zone differences. All classes begin promptly at the scheduled time. The Studio is not responsible for missed classes or partial attendance resulting from a participant’s failure to review class details or confirm start times, and refunds are not guaranteed in such instances.
Audit participants and lecture attendees may receive access information on the day of the event. If a class is approaching and access information has not been received, participants should contact the Studio at contact@bergstudios.com.
Anti-discrimination and anti-harassment policy
The Studio is committed to maintaining a safe, inclusive, and respectful learning environment for all students and guests. The Studio seeks to support actors by upholding professional standards, enforcing its policies consistently, and fostering a diverse community of artists with opportunities to learn and grow. The Studio community reflects a wide range of cultural, ethnic, religious, and personal backgrounds, and the Studio is committed to respecting and supporting that diversity.
Coursework may at times involve discussion of sensitive subject matter or the use of emotionally intensive material. Students will not be required to engage in any activity that places them in physical, emotional, or psychological harm. Students are encouraged to consider their own well-being and to maintain appropriate mental and emotional health when participating in Studio programs. Except where disclosure is required by law or necessary to address a potential risk of harm, personal information shared in the course of instruction will be handled professionally and with appropriate discretion. Students are encouraged to exercise judgment when sharing personal information.
The Studio does not discriminate in its programs or activities on the basis of any characteristic protected under applicable federal, state, or local law, including but not limited to race, color, national or ethnic origin, ancestry, age, religion or creed, disability, sex or gender (including pregnancy and sexual harassment), gender identity or expression, sexual orientation, military or veteran status, genetic information, or any other legally protected status. Retaliation against any individual for raising a concern or complaint is strictly prohibited. All reports of discrimination or harassment will be taken seriously and addressed as promptly and confidentially as reasonably possible.
The Studio is committed to providing an environment free from unlawful harassment. Harassment based on any protected characteristic will not be tolerated. The Studio reserves the right to investigate and take appropriate action in response to conduct that violates its policies or standards, including conduct that threatens the safety, well-being, or dignity of others.
Any student whose behavior is determined by the Studio, in its sole discretion, to be inappropriate, disruptive, threatening, abusive, or otherwise in violation of Studio policies—whether occurring on Studio premises, within online programs, or at any Studio-related event—may be subject to disciplinary action, including immediate dismissal without refund. Where applicable, the Studio may also pursue legal remedies.
Unlawful discrimination and harassment are strictly prohibited and are inconsistent with the Studio’s mission to provide a safe and professional learning environment for all participants.

Any unauthorized reproduction, distribution, posting, copying, duplication, modification, or repurposing of such materials, outside of their intended educational use, is strictly prohibited.
Unless otherwise expressly stated or where materials are in the public domain, all ideas, concepts, themes, exercises, methods, instruction, class titles, terminology, and related materials—whether physical, digital, or conceptual—provided through the Studio’s programs, communications, or websites are deemed the intellectual property of the Studio and are protected under applicable copyright and intellectual property laws.
The Studio retains all rights, title, and interest in its intellectual property and does not grant any license or permission for its use by any student, guest, or third party, except as expressly authorized in writing. Enrollment in any class or program does not constitute permission to access, use, reproduce, or distribute Studio materials beyond their intended purpose.
The Studio reserves the right to take legal action, as necessary, to protect its intellectual property, proprietary materials, and brand. This includes, but is not limited to, instances in which Studio programs, materials, or methods are reproduced, imitated, repackaged, or otherwise used by any individual or entity for financial or other gain, particularly where such use may cause confusion, dilution, or harm to the Studio’s brand, reputation, or business, regardless of whether direct damages can be immediately demonstrated.

These Terms and Conditions may be modified at any time, and any updates will be posted on this page.
